Terms and Conditions

This document describes and specifies the Terms and Conditions of sale and use of services and facilities offered by Pylatica Studio. These conditions apply to any natural or legal person using said services and facilities without exception, hereinafter referred to as "the member." These conditions may be amended at any time without notice. In such cases, members will be informed of any changes. Each member must sign a copy of this document after reading it during registration. This document will also be available and accessible at all times on the Pylatica Studio website.

   1. Offers, Services, and Facilities

Pylatica Studio offers its members physical fitness and well-being services through the teaching and application of physical training techniques such as Pilates, fitness, stretching, yoga, dance, meditation, massage, breathing, sports coaching, and nutrition.

​

In this regard, Pylatica Studio utilises various platforms and facilities: a studio located at 101 Avenue du Castel, 1200 Brussels, a website (www.pylatica.com), an email address (pylatica@gmail.com), a phone number (+32 485 543 847), an Instagram account (pylatica_studio), a Facebook page (Pylatica Studio), and a bank account (BE49 7340 7125 2771).

   2. Liability

Pylatica Studio is insured for civil liability. Similarly, each member must have valid civil liability insurance at the time of registration and throughout the duration of their activity within the studio. If desired, each member may take out additional "individual accident" insurance.

​

The member affirms that their current health condition allows them to engage in physical activity and use the services, activities, equipment, and facilities offered by Pylatica Studio. They acknowledge having their doctor verify their fitness for physical activity and taking all necessary precautions for their health and safety before commencing the use of Pylatica Studio services.

​

The member acknowledges that personal training and Pilates practice are in no way a medical treatment. The information specified on the registration form is solely intended to determine limitations in terms of physical exercises.

​

The member acknowledges that there are certain risks associated with the practice of any sport (e.g., incorrect movement, variation in heart rate, etc.) and that neither the instructor nor Pylatica Studio can be held responsible for these risks, nor for an accident resulting from the member's failure to follow equipment usage and safety instructions.

​

In the case of pregnancy, the member undertakes to inform Pylatica Studio as soon as possible and to provide a medical certificate authorising sports practice.

​

Pylatica Studio disclaims any responsibility for the loss, theft, or direct or indirect damage to the personal belongings of the member within its facilities.

​

It is strictly forbidden to damage or degrade in any way the facilities, installations, and/or equipment provided by Pylatica Studio. The use of facilities and equipment is subject to these regulations or the instructions of the instructors, who have full authority in this matter. In case of intentional or accidental damage to equipment and/or facilities, the costs of repair will be borne by the responsible member or members.

   3. Registrations, Payments, and Subscriptions

Anyone wishing to access the services and facilities offered by Pylatica Studio must first purchase a valid subscription. The rates in force are those announced on the website on the day of purchase and are presented in euros, all taxes included. Once the purchase is made, the registration form and the General Terms and Conditions document filled and signed, the person will be considered a member of Pylatica Studio for the entire validity period of the subscription. Subscriptions are valid for a maximum of 4 months from the date of purchase.

The payment methods are as follows: in cash or via Payconiq during the first session, and subsequently in cash, via Payconiq, or by bank transfer.

​

Single-class subscriptions must be paid in cash or via Payconiq directly on-site. Multiple-class subscriptions must be paid in cash or via Payconiq directly on-site or in advance by bank transfer so that the payment reaches the Pylatica Studio account 24 hours before the start of the first class.

​

In case a class experiences a change in the number of participants, and thus the price of the class is modified, the payment of the additional amount must be made on-site at the beginning of the class, either in cash or via Payconiq. This may happen if a trio class becomes a duo class or if a duo class becomes a private class, and the person who cancels their participation does so 24 hours in advance. In this case, the class will not be billed to them, and the other participants will be offered the choice to continue in a duo instead of a trio or in private instead of a duo or to cancel their participation.

​

In the event of withdrawal after a purchase, the member has a 14-day period from the day after the purchase date to request, clearly via email to pylatica@gmail.com, a cancellation of the purchase and a refund of the amount paid without justification or reason. The purchased subscription must not have been used or started; otherwise, no refund will be granted. After this period, no refunds will be given.

​

In the event of the competent authorities enforcing Covid-type regulations leading to a partial or total closure of public places and a temporary partial or total suspension of classes, the validity period of all ongoing subscriptions would be extended so as not to penalise any member.

​

   4. Classes

Classes are available by appointment only and last for 55 minutes.

​

The initial session is conducted privately to professionally assess the member's needs and objectives. This first session cannot be included in a multiple-class subscription and must be paid on-site, either in cash or via Payconiq.

​

To avoid session charges, members commit to notifying Pylatica Studio 24 hours in advance of any cancellation or schedule change for scheduled sessions.

​

No multiple-class subscription that has already commenced or exceeded the aforementioned refund period will be refunded. However, remaining classes can be transferred to another person, provided the subscription validity period is respected, along with the entire registration procedure for a new individual.

​

Minors under 12 years old will not be accepted in the studio, whether in person awaiting a parent or guardian (except with the express and exceptional permission of a teacher), or as members for pedagogical and physical reasons, except for any classes specifically designed for them. Minors will be accepted as members from the age of 12 with a signed authorization from a parent or legal guardian. This regulation must be signed by the parent or legal guardian and by the minor, who must comply with the rules.

   5. Internal Regulations

   Behavior

Every member is expected to exhibit impeccable, polite, calm, and courteous behavior, respectful of other members, instructors, as well as the facilities, equipment, and the smooth conduct of classes.

​

In this regard, members are specifically asked to leave their mobile phones in the provided lockers or, with the express and exceptional consent of the teacher, on silent mode in the classroom (e.g., medical emergency); wait for and follow the instructors' instructions regarding the use of studio facilities and equipment; maintain a decent and proper level of personal hygiene to avoid inconveniencing others (e.g., wear clean socks for class); refrain from being under the influence of any toxic or chemical substances (drugs, medication, alcohol, etc.) or introducing them into the studio; and finally, abstain from smoking and/or consuming food and drinks other than water within the studio premises.

​

Individuals with obvious injuries, infected wounds, severe skin infections, etc., are not allowed in the studio. Animals are not allowed in the studio, even if on a leash, for reasons of comfort, quality, safety, and hygiene.

​

In case of a declared contagious disease, feverish symptoms, or similar elements, members are requested to courteously cancel their class 24 hours in advance to avoid infecting others. Cancellation must be made 24 hours in advance to avoid class charges. If a member, partially or fully ill or injured, still attends the class, the present teacher has the authority to decide what is appropriate, taking into account the safety and health of all present, without the member being able to refuse or contest the decisions made by the teacher. The member may be asked to wear a mask to protect others, or even leave the premises, depending on the severity estimated by the teacher. In such a situation, the member's class will be considered due and billed.

It is strictly prohibited at all times and in all places to adopt an aggressive or threatening behaviour that may jeopardise or question the physical or psychological integrity of other members and/or teachers, regardless of the reasons invoked elsewhere, or to make any threats, insults, racist, xenophobic, or otherwise offensive remarks towards teachers or other attending members. In such a situation, the present teacher has full authority to demand the immediate cessation of the offending member and even exclude them if the situation requires. Under no circumstances can the offending member contest this decision. They will be asked to comply with the teacher's decision, and their class will be considered due and billed. A permanent exclusion could result from such a situation if applicable.

​

   Dress Code

Upon arrival, members must first remove their shoes in the designated area and properly store them in the locker to maintain the studio as clean and pleasant as possible.

​

During the session, members are requested to wear comfortable sportswear that allows unrestricted mobility and a pair of clean socks to respect the teacher, other students, and the equipment. For hygiene reasons, being barefoot is not allowed, and no pair of shoes will be accepted in the training area or in the changing rooms or toilets, even if they are indoor and/or sports shoes only, except for those of the teachers.

​

Members should not have on them or on their clothing any elements likely to cause damage to the studio equipment or cause an accident or injury. This includes avoiding zippers, all types of jewelry, hairpins (preferably using an elastic band), etc.

​

Finally, members are advised to bring a small water bottle and possibly a towel if necessary.

​

   Changing Rooms and Lockers

Changing rooms and storage lockers are provided for members. Respect and cleanliness are expected in their use.

​

Members must undress and dress in the provided changing rooms and leave them in perfect order and cleanliness. When using a changing room, the curtain must be completely drawn, and when finished, the curtain should be left wide open and neatly arranged on the right side in an obvious manner. The changing room is available to the member only for the duration of the session, and no personal belongings may be left after changing.

​

Members must deposit their personal belongings in one of the provided lockers. A key lock system will be available on each locker. The member is responsible for the key used and is asked to leave it on the lock of the corresponding locker at the end of the session. In case of key loss, Pylatica Studio will replace the lock and key at the expense of the responsible member.

​

   Toilets

Toilets are available for members. Respect and cleanliness are requested in their use. Please consider other members as well as the cleaning staff.  It is strictly forbidden to throw anything other than toilet paper into the toilet, including tampons, sanitary pads, or other items. A closed bin will also be available for such necessities. Please bear in mind that no one wants the toilets to be blocked and out of service.

   Parking

A setback area is situated between the sidewalk edge and the entrance to the studio. It primarily consists of two parking spaces provided for Pylatica Studio members. These spaces are intended for cars and motorcycles. It is not allowed to park vans or any other similar vehicles, nor scooters, cargo bikes, or scooters. Regular bicycles and private kick scooters can be attached to the right side of the setback area along the gate, but not cargo bikes or scooters that are too wide. Adequate space must be left between regular bikes and any car parked on the right to prevent accidents or incidents. Members are requested to use these spaces only for the time strictly necessary for their session.

Cars are also requested to park with the back of the vehicle against the curb to leave sufficient space between the front of the vehicle and the entrance to the studio, allowing members to enter and exit comfortably. Cars are also asked to pull to the left to leave space for bikes along the gate on the right side of the setback area.

​

The setback area is an integral part of Pylatica Studio's facilities and is therefore subject to the same rules of respect, courtesy, calm, and safety as the rest of the installations. The rest of the setback area at the foot of the building is not part of Pylatica Studio's facilities but belongs to other tenants of the building. Therefore, it is strictly forbidden to park there. No vehicle is allowed inside the studio (bike, scooter, kick scooter, others), and all vehicles must be left outside in accordance with the current parking regulations.

​

   6. Facilities, Equipment, and Safety

In general, the member acknowledges the right of Pylatica Studio's management and the teachers present during classes to temporarily or permanently exclude any person whose attitude, behavior, statements, health, or attire would be contrary to good morals, notably troublesome, offensive, threatening, or aggressive to other members, potentially compromising the safety or physical or psychological integrity of other members in any way or not in accordance with safety, hygiene, and facility and equipment usage guidelines. In such a situation, no subscription refund will be granted.

​

In any situation requiring a decision regarding safety, hygiene, behavior, facility and equipment usage, exercise execution, or other, not explicitly mentioned and provided for in this regulation, authority lies with the responsible teacher present at Pylatica Studio at the time of the incident. Members present must comply, if necessary, at all times and in all places with the instructions and decisions of the teacher.

​

No intentional or accidental damage or harm to facilities and equipment will be accepted. If applicable, any intentional or accidental damage will be repaired by Pylatica Studio at the expense of the responsible member or members.

​

   7. Data Processing and Confidentiality

Pylatica Studio acknowledges that all information collected from the member during their registration (name, first name, address, email address, phone number, personal or medical information) is strictly confidential and will neither be shared nor sold to third parties, except with the member's consent or to provide requested services.

 

The member authorizes Pylatica Studio to collect, process, and use their personal information strictly within the scope of the services offered and sold. Pylatica Studio must or will have to use certain management platforms or software to provide its services to its members. The member understands and acknowledges this situation, authorizing Pylatica Studio to use their personal information for this purpose only.

​

   8. Dispute and Law

These General Conditions are governed by Belgian law. Any dispute related to the interpretation or execution of these General Conditions will be submitted to the jurisdiction of the French-speaking courts of the judicial district of Brussels.

​

The nullity of all or part of these General Conditions does not, under any circumstances, render null and void the other provisions or the portion of the provision unaffected by nullity.

​

For the convenience of members, there are two versions of this regulation: one in French and another in English. However, in case of doubt about the regulation, its nuances, and/or its interpretation, the French version will be considered the reference version.
