Terms of sale
1. Provider identity and scope
These terms of sale ("Terms") govern the services offered under the Pylatica Studio name ("Pylatica"), operated by Pylatica SRL, whose registered office is at Avenue du Castel 101, 1200 Brussels, registered with the Belgian Crossroads Bank for Enterprises under number BE0805.322.605 and liable for VAT under number BE0805.322.605. Pylatica can be reached at pylatica@gmail.com and on +32 485 54 38 47.
They apply to any booking or purchase of a class, pack, subscription or gift voucher, whether made at the studio, by phone, by email or through the www.pylatica.com website and its booking platform. They apply to consumer clients; any B2B services are covered by a separate agreement.
Booking or purchasing implies express acceptance of the Terms applicable on that date. The Client may download, save and print them. In the event of a contradiction, the particular conditions clearly communicated to the Client prevail.
2. Services and access to the studio
Pylatica offers supervised Pilates Mat and Reformer classes, as well as personalised coaching, usually lasting 55 minutes, in the formats displayed at the time of booking: Solo, Duo, Group.
Products and services fall into two categories: (i) single classes and packs of eight (8) classes ("Packs") and (ii) subscriptions, referred to as "Memberships". The features, price, number of classes included where applicable, frequency, duration and particular rules of each Membership are stated before it is taken out.
Classes are given in a private or semi-private setting, by booking and subject to availability. The descriptions, access conditions, schedules, instructors and prices displayed on the site or the platform form part of the pre-contractual information.
The Client arrives at the agreed time, suitably dressed. Non-slip socks are compulsory; Pylatica may offer them for sale. A water bottle is recommended. In order to preserve everyone's comfort, the Client respects the premises, the equipment, the coaches and the other clients.
3. Booking, formation of the contract and prices
Bookings are made through the process indicated by Pylatica. The Client checks their details and the chosen time slot before confirming. The contract is concluded once Pylatica has confirmed the booking or the payment; a confirmation is sent on a durable medium, generally by email.
Prices are stated in euros and include all taxes, unless otherwise indicated. The applicable price is the one displayed at the time of the order. Payments are made using the means offered on the platform or communicated by Pylatica. If payment is not made when due, Pylatica may suspend future bookings after a reasonable reminder, without prejudice to each party's legal rights.
A price change does not apply to classes, packs or subscriptions already validly purchased, unless the Client agrees or the law provides otherwise.
4. Single classes and Packs of 8 classes
A single class gives access to one class, in the format booked. The Pack comprises eight (8) class credits, usable exclusively in the format, or according to the conversion rules, clearly stated at the time of purchase. Single classes and Packs cannot be converted into cash.
Single classes and Packs of 8 classes are valid for four (4) months from their date of purchase. After expiry, unused credits are lost, subject to the Client's mandatory rights.
Credits from a single class or a Pack may be transferred free of charge to a third party, provided that this third party has first registered with Pylatica, accepts these Terms and complies with the studio's house rules. The transferred credit keeps its date of purchase and remains subject to the same booking, cancellation, validity or limitation periods that may apply, as well as to all other applicable conditions. The transfer only takes effect once it has been recorded by Pylatica or through the booking system where that feature is available. Memberships are neither assignable nor transferable.
Single classes and Packs are not refundable after any legal withdrawal period, subject to the Client's mandatory rights. An exceptional extension may be granted at Pylatica's discretion in the event of a serious impediment, duly justified and reported without delay; it does not constitute an acquired right.
5. Memberships (subscriptions)
A Membership is a subscription giving access to the services and benefits expressly described at the time it is taken out. Pylatica currently offers the following Memberships:
- Essential: one (1) class per week, that is four (4) classes per cycle of twenty-eight (28) days, at a price of 170 € per cycle;
- Progress: two (2) classes per week, that is eight (8) classes per cycle of twenty-eight (28) days, at a price of 320 € per cycle.
Each Membership runs in successive cycles of twenty-eight (28) days. Taking one out involves a firm initial commitment of three (3) cycles, that is eighty-four (84) days. The total price of this initial commitment is therefore 510 € for Essential and 960 € for Progress, unless a mandatory legal provision states otherwise or Pylatica agrees in writing.
At the end of the initial commitment, the Membership renews automatically in successive cycles of twenty-eight (28) days. The Client may end it without penalty by giving notice of termination by email to pylatica@gmail.com or on +32 485 54 38 47 at least seven (7) days before the next payment date. A request received within this period takes effect at the end of the current cycle; a request received later takes effect at the end of the following cycle. This notice period cannot deprive the Client of the mandatory rights granted to them by law.
Memberships are personal and non-transferable. By way of exception, the Client may carry over to the immediately following cycle a limited number of unused classes: one (1) class for Essential and two (2) classes for Progress. Carried-over classes must be used during that following cycle; failing this, they are permanently lost. All other classes left unused at the end of a cycle are considered used and are neither refunded, nor carried over, nor accumulated.
Any change to the price, frequency or content of a Membership for a future period is communicated to the Client with reasonable notice. If this change is substantial and unfavourable, the Client may terminate before it takes effect, at no cost for the future, subject to the performance of services already due.
6. Cancellation, rescheduling and absence
The Client may cancel or reschedule a class free of charge up to twenty-four (24) hours before its start time, through the booking platform or, if that is not possible there, in writing to pylatica@gmail.com or on +32 485 54 38 47. In that case, the class is neither charged nor debited from the Pack or the Membership.
Any late cancellation, arrival too late to take part, or unjustified absence results in the booked class being debited: it is considered due, used and cannot be carried over. This rule protects an individual time slot or a limited place that can generally no longer be given to another client.
If Pylatica cancels, in particular because a coach is unavailable, for a technical problem, an exceptional closure or force majeure, the class is not debited. Pylatica will offer, where possible, a reschedule or an equivalent credit. This provision does not limit the Client's legal rights in the event of a failure attributable to Pylatica.
7. Health, safety and liability
The Client undertakes to inform the coach, before the class, of any contraindication, pain, pregnancy, injury, recent operation, condition or treatment likely to affect their practice. In case of doubt, they consult a healthcare professional before starting or continuing physical activity.
Safety instructions and the adaptations offered by the coach must be followed. The Client practises within the limits of their abilities and refrains from any exercise in the event of unusual pain or discomfort, which they report immediately.
Pylatica applies the reasonable means expected of a professional studio to provide supervision and safety. Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited, in particular in the event of fault, negligence or a failure attributable to Pylatica.
The Client remains responsible for their personal belongings. Pylatica is not liable for their loss, theft or damage unless fault on its part is demonstrated.
8. Right of withdrawal for distance selling
Where a contract is concluded at a distance with a consumer, that consumer is in principle entitled to a right of withdrawal of fourteen (14) calendar days, in accordance with the Code of Economic Law, save for legal exceptions.
In accordance with article VI.53, 12° of the Code of Economic Law, this right does not apply to the booking of a class or a leisure activity scheduled for a specific date or period of performance. Booking a given time slot is therefore, in principle, excluded from the right of withdrawal.
For a pack, a subscription or a service not tied to a given time slot, the Client may exercise their right of withdrawal within the legal period, unless they have expressly requested that performance begin during that period. In the latter case, they remain liable for the amount proportionate to the services already performed; if the service has been performed in full with their express agreement and after acknowledging the loss of the right of withdrawal, that right is lost in accordance with the law.
9. Gift vouchers
Gift vouchers are valid for the period indicated at the time of purchase. Failing such an indication, they are valid for twelve (12) months from the date of issue. They may be used for the services specified, subject to availability, and are neither exchangeable for money nor refundable, save for any applicable legal right.
10. Personal data and communication
The personal data required for booking, payment, invoicing, monitoring the services and safety is processed in accordance with Pylatica's privacy policy, available on www.pylatica.com. To exercise their rights or ask a question, the Client contacts pylatica@gmail.com.
Commercial communications are sent only in accordance with the applicable rules and, where consent is required, with the possibility of withdrawing it at any time.
11. Complaints, governing law and disputes
Any complaint is addressed first to Pylatica at pylatica@gmail.com, with the relevant information, in order to seek an amicable solution within a reasonable time.
These Terms are governed by Belgian law. If the Client is a consumer, no provision deprives them of the mandatory protection they enjoy or of the jurisdiction of the legally designated courts. The parties may also use an out-of-court dispute resolution mechanism where one is applicable.
12. Changes and severability
Pylatica may change the Terms for the future. The applicable version is the one accepted by the Client when placing their order, unless a change is imposed by law or expressly accepted by the Client. If a clause is invalid or unenforceable, the other clauses remain in force to the extent permitted by law.
